TERMS OF SERVICE
Welcome to Jupiter, a creator-driven recipe and grocery shopping platform. The following terms of service ("Terms") govern your use of our platform and any content or services provided through the platform. By accessing or using Jupiter, you agree to be bound by these Terms, which constitute a legally binding agreement between you and Jupiter. If you do not agree to these Terms, please do not use Jupiter.
1. Description of Jupiter
Jupiter is a platform that allows creators to share recipes and grocery shopping lists with users. We provide a platform for creators to publish recipes and shopping lists and for users to browse and use these recipes and lists. Jupiter is not responsible for the content created by creators, and we do not guarantee the accuracy, completeness, or quality of any content on the platform.
2. Registration
To use Jupiter, you must register for an account. You agree to provide accurate and complete information when registering for an account, and you agree to keep your account information up to date. You are responsible for maintaining the security of your account and password, and you agree not to share your password with anyone else. You are also responsible for all activities that occur under your account.
3. User Content
Jupiter allows users to submit content, including recipes and reviews. By submitting content to Jupiter, you represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish and distribute any content you submit to Jupiter. You also agree that your content will not infringe or violate the rights of any third party, including intellectual property rights, privacy rights, and publicity rights.
4. Prohibited Conduct
You agree not to use Jupiter to:
* Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable;
* Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;
* Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation;
* Engage in any activity that disrupts, interferes with, or otherwise harms the operation of Jupiter or the servers or networks connected to Jupiter;
* Use any automated means, including bots, robots, spiders, or scrapers, to access Jupiter or collect information from Jupiter;
* Violate any applicable laws or regulations.
5. Intellectual Property
Jupiter and its content, including but not limited to text, graphics, logos, images, and software, are the property of Jupiter or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You agree not to reproduce, modify, distribute, display, perform, or otherwise use any of Jupiter's content without our prior written consent.
6. Indemnification
You agree to indemnify and hold Jupiter, its affiliates, and their respective officers, directors, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of Jupiter, your breach of these Terms, or your violation of any applicable laws or regulations.
7. Disclaimer of Warranties
Jupiter is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of Jupiter or the information, content, materials, products, or services included on or otherwise made available through Jupiter. You expressly agree that your use of Jupiter is at your sole risk.
To the fullest extent permissible by applicable law, we disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We will not be liable for any damages of any kind arising from the use of Jupiter, including, but not limited to, direct, indirect, incidental, punitive, and consequential damages.
8. Limitation of Liability
In no event shall Jupiter, its affiliates, or their respective officers, directors, employees, or agents be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from or arising out of your use of Jupiter, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages. You specifically acknowledge that Jupiter shall not be liable for user content or the defamatory, offensive, or illegal conduct of any third party.
9. Termination
We reserve the right to terminate or suspend your access to Jupiter at any time, with or without cause, and with or without notice. Upon termination, your right to use Jupiter will immediately cease.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law.
11. Changes to these Terms
We may update these Terms from time to time, and the updated Terms will be posted on Jupiter. Your continued use of Jupiter after the posting of the updated Terms constitutes your acceptance of the updated Terms.
12. Miscellaneous
These Terms constitute the entire agreement between you and Jupiter regarding the use of Jupiter. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
13. Third-Party Websites and Services
Jupiter may contain links to third-party websites or services that are not owned or controlled by Jupiter. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Jupiter shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such website or service.
